Overview

Grand & Toy Grand Rewards™ ("Grand Rewards™") is a customer reward program offered by Grand & Toy, Ltd. (“Grand & Toy”) that allows members (“members”, “you” or “your”) to earn 25 Rewards Points for every $500 in qualified purchases made during the year. Additionally, from time to time, Grand & Toy may provide Grand Rewards™ members with Grand Rewards™ Bonus Offers on purchases of specified products or services. You will also receive exclusive savings offers through the mail and email. If you do not want the exclusive savings offers, just use the unsubscribe mechanism in each of our emails, log into your account and change your profile or call 1-866-391-8111.

You may begin using your Grand Rewards™ membership immediately for all qualifying purchases (defined below), including qualifying purchases eligible to receive Grand Rewards™ Bonus Offers. There is a limit of one Grand Rewards™ Account per Grand & Toy Business Account.

Grand & Toy reserves the right to enroll eligible customers into Grand Rewards. You may opt out of the program by calling either your dedicated account manager or our Customer Service Centre at 1-866-391-8111

Eligibility

There is no membership fee to participate in Grand Rewards™. Grand Rewards™ is open to select Grand & Toy Business Account holders who have been invited to join Grand Rewards™ and who have internet access to manage their Grand Rewards™ Account. To receive an invitation or to determine if you qualify, contact us at 1-866-391-8111. Grand Rewards™ membership is not available to re-sellers selling Grand & Toy products.

If for any reason, your account becomes no longer eligible, Grand & Toy reserves the right to remove you from the program, and you will be notified of such removal in a timely manner. Any unused Rewards Points will remain on your account to be used towards future purchases. You will not accumulate any points from those future purchases.

How To Earn Rewards Points

Grand Rewards™ Points. GRAND REWARDS™ POINTS HAVE NO MONETARY VALUE AND CANNOT BE REDEEMED FOR CASH OR OTHERWISE, EXCEPT IN ACCORDANCE WITH THESE TERMS & CONDITIONS. Grand Rewards™ members will earn 25 Rewards Points when they spend $500 (before tax and after eligible discounts) at Grand & Toy in qualifying purchases during the year. If you are shopping online or by phone or fax, you will increase your Grand Rewards™ Account balance by charging your order to your Grand & Toy Business Account. You will increase the balance of your Grand Rewards™ Account with every qualifying purchase that you make. The amount of your qualifying purchases will be recorded in your Grand Rewards™ Account when the related purchase is invoiced.

Grand Rewards™ Bonus Offers. From time to time, Grand & Toy may also offer its members Grand Rewards™ Bonus Offers. For example, Grand Rewards™ members may be able to earn extra Rewards Points (which may vary in amount) or may be able to further increase their Grand Rewards™ Account balance for purchasing specified products or completing a required action during the specified promotional window. To take advantage of Grand Rewards™ Bonus Offers, you must charge your purchase to your Grand & Toy Business Account. From time to time, Grand Rewards™ Bonus Offers will also require a coupon code to qualify. No Grand Rewards™ Bonus Offers may be applied to previous purchases.

Qualifying Purchases

Qualifying purchases are any products or services available in Grand & Toy catalogs or on our website excluding special order furniture, freight charges, equipment installation charges, restocking fees, electronic handling fees, delivery charges, and branded promotional items charged to your Grand & Toy Business Account.

How To Obtain And Use Rewards Points

You can easily keep track of your Grand Rewards™ Account balance and any Rewards Points you have earned by logging in to your Grand Rewards™ Account online at www.grandandtoy.com. Grand & Toy will send you an electronic statement notification via email at the end of each month. You may opt-out of receiving this notification by logging in to your account and updating your communication preferences or by calling Customer Care at 1.866.391.8111.

Your Rewards Points will be available approximately 30-days following the date on which your Grand Rewards™ Account balance reaches $500, subject to any change, cancellations or refunds. Your Rewards Points obtained through Grand Rewards™ Bonus Offers will be available approximately 30-days following the date on which the related purchase was invoiced, subject to any change, cancellations or refunds. You may use your Rewards  online at www.grandandtoy.com, or by calling 1.866.391.8111. Rewards Points can be used towards your future purchases. For each Reward Point redeemed, one (1) dollar will be deducted from the balance of your order. Reward Points must be redeemed in whole Rewards Point increments. The number of Rewards Points redeemed on each purchase must be rounded up to the nearest dollar (i.e. if your order is $49.50, 50 Rewards Points will need to be redeemed to cover the entire amount).

Rewards Points are not redeemable for Grand & Toy gift cards, third-party gift cards (i.e. restaurant, music, travel, or entertainment gift cards, other merchants’ gift cards, etc.), general use pre-paid cards (i.e Visa® gift cards, MasterCard® gift cards, and American Express® gift cards), phone cards and are not redeemable for cash. No amount of your Rewards Points may be applied as payment to any credit account, including the Grand & Toy Business Account. See below for additional details and expiry information.

Returns

If an item that contributed to your Grand Rewards™ Account balance is returned, the amount of the returned item will be deducted from your Grand Rewards™ Account balance and, any Rewards Points that were accumulated or issued in conjunction with that purchase will be reversed. If you return a product that was purchased using Rewards Points, we will credit those Rewards Points back to your Grand Rewards™ Account. If you exchange a product, your Grand Rewards™ Account balance and/or Rewards Points balance will not be affected (provided the total amount of the originally invoiced amount is unchanged).

Expiration Of Grand Rewards™ Account Balances And Rewards

Grand & Toy reserves the right to expire Rewards Points if there is no purchase activity on your Grand Rewards™ Account for twelve (12) consecutive calendar months. Membership will be deemed as inactive and all accumulated Rewards Points will be forfeited.

Modifications And Termination Of Grand Rewards™

Grand & Toy reserves the right to modify any of these Terms and Conditions including the qualifying purchases, the amount of the Rewards Points, and any of the options available to you on your Grand Rewards™ Account at any time, with or without notice, even though these changes may affect your ability to accrue or use Rewards Points. Your continued participation in Grand Rewards™ constitutes your acceptance of any changes to these Terms and Conditions. You are responsible for remaining knowledgeable as to any changes that Grand & Toy may make to these Terms and Conditions. The most current version of these Terms and Conditions will be available at grandrewards.ca and will supersede all previous versions of these Terms and Conditions.

Grand & Toy reserves the right to terminate Grand Rewards™ at any time, for any reason, with or without notice, even though termination may affect your ability to accrue or use your Rewards Points.

Privacy

When you enroll in Grand Rewards™, Grand & Toy may collect personal information, including your name, address, telephone number and email address. We use this information to administer your participation in the program. For more information on the manner in which we treat your personal information, please refer to our Privacy Statement.

General Terms And Conditions

This program is void where prohibited by federal, provincial or local law.

Grand & Toy reserves the right to close your Grand Rewards™ account if you engage in any fraudulent activity or use Grand Rewards™ in a manner inconsistent with these Terms and Conditions or any federal, provincial or local, laws, statutes or regulations. As a result you may lose all accumulated Rewards Points earned but not yet issued and Rewards Points issued but not yet redeemed, including but not limited to Rewards Points earned from Bonus Offers. In addition, Grand & Toy shall have the right to take appropriate administrative and/or legal action, including criminal prosecution, as it deems necessary in its sole discretion, and you will not be permitted to participate in Grand Rewards™ in the future.

Rewards Points are not your property and may be revoked by Grand & Toy at any time. Rewards Points may not be sold, transferred or assigned, and are not transferable upon death, as part of a domestic relations matter or otherwise by operation of law.

Grand & Toy is not responsible for any incorrect or inaccurate information supplied by you while participating in Grand Rewards™. It is your sole responsibility to ensure the accuracy of the information provided to Grand & Toy, both at the time of enrollment and throughout the period of membership in Grand Rewards™, and to inform Grand & Toy in the event of any changes. Providing false information, omitting any information required, failure to keep information accurate and current, or non-compliance with these Terms and Conditions may be grounds for denial or termination of membership in Grand Rewards™, and/or the cancellation of any Rewards Points earned hereunder.

All questions or disputes regarding eligibility for Grand Rewards™, earning or redemption of Rewards Points, or your compliance with these Terms and Conditions will be resolved by Grand & Toy in its sole discretion.

Except as prohibited by the laws of another jurisdiction all issues and questions concerning the construction, validity, interpretation and enforceability of the Terms and Conditions, or your rights and obligations shall be governed by, and construed in accordance with, the laws of the province of Ontario, without giving effect to any choice of law or conflict of law rules.

These Terms and Conditions constitute the entire agreement between Grand & Toy and you. They supersede all prior or other arrangements, understandings, negotiations and discussions, whether oral or written.

No waiver of any of the provisions of these Terms and Conditions shall be deemed or shall constitute a waiver of any other provisions hereof. No delay or omission on the part of Grand & Toy to exercise any right or remedy hereunder, or otherwise to enforce these Terms and Conditions shall be deemed to be a waiver of these Terms and Conditions or any applicable remedy to which it may be entitled. No waiver shall constitute a waiver of any other term, condition, default, breach, right or remedy, nor shall any waiver constitute a continuing waiver, unless otherwise expressly provided.

If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed from the remainder of these Terms and Conditions, which will otherwise remain in full force and effect. Grand Rewards™ is run by Grand & Toy, Ltd.

Limitations Of Liability

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY. AS SUCH, SOME OF THE FOLLOWING LIMITATIONS MAY NOT APPLY TO YOU.

Grand & Toy and its partners, affiliates, subsidiaries, parent corporations and their respective agents and agencies (“Releasees”) are not responsible for incorrect or inaccurate transcription of information, for problems related to any of the equipment or programming associated with Grand Rewards™, for any human error, for any interruption, deletion, omission, defect, or line failure of any telephone network or electronic transmission, for problems relating to computer equipment, software, inability to access the rules or online service, or for any other technical or non-technical error or malfunction. In the event of a problem with any items purchased with Rewards Points, Releasees shall not have any liability.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, UNDER NO CIRCUMSTANCES, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE, SHALL ANY OF THE RELEASEES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES ARISING FROM GRAND REWARDS™ OR MERCHANDISE PURCHASED WITH GRAND REWARDS™ POINTS, EVEN IF ANY OR ALL OF THE FOREGOING OR ANY OF THEIR AUTHORIZED REPRESENTATIVES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IF GRAND & TOY IMPROPERLY DENIES YOU ANY REWARDS POINTS, LIABILITY WILL BE LIMITED TO THE EQUIVALENT AMOUNT OF REWARDS POINTS OR $100, WHICHEVER IS LESS. You agree to rely solely on the manufacturer's warranties, if any, for any products purchased with Grand Rewards™ Points.
